Procurement: New rules on financial flows
The purpose of this circular is to illustrate the traceability obligations of financial flows relating to public contracts for works, services and supplies, introduced by Law no. 13, containing the “Extraordinary plan against the mafia, as well as delegation to the Government in the matter of anti-mafia legislation”.
The regulatory framework essentially consists of:
- by articles 3 6 of L 136/2010 of 13 August;
- by articles 6 and 7 of Legislative Decree 12 November 2010 n 187;
- 17 of December 2010, 217 conversion of Legislative Decree 187/2010, published in the Official Gazette of December 18, 2010, no. 295.
The Authority for the Supervision of Public Contracts for Works, Services and Supplies (hereinafter AVCP) intervened on the matter with the following decisions:
- N.8 of 18 November 2010 - First indications on the traceability of financial flows;
- No. 10 of 22 December 2010 - Further information on the traceability of financial flows.
