Competition Law: the Leasing Agreement

  Law no. 124 of 4 August 2017, published in the Official Gazette no. 189 on 14 August 2017 and in force since 29 August, (hereinafter also the "Law on Competition"), also in application of the rules of Community law, has regulated, among other things, the discipline of the leasing contract, which up to now has between atypical contracts or contracts lacking a specific primary reference standard. In this way, certain definition and rules are given to leasing to guarantee the contracting parties, in line with the provisions of the bankruptcy law, in order to have a univocal discipline, also consistent with the nature of the grantors, which can only be banks and financial intermediaries supervised by the Bank of Italy. With this Newsletter we intend to shed light on the main aspects of the new discipline, clarifying in particular what are the rights and obligations of the leasing company and the customer, and what the causes and effects of termination due to default, with a mention also to any accounting and tax consequences.   Newsletter no. 7/2017
